Expert Home Auctions International (hereinafter Auctioneer) will offer the property for auction on the Expert Home Auctions International a internet website, www.experthomeauction.com, according to the following terms and conditions:

Preforeclosure auctions subject to lenders confirmation. Equity auctions may have a reserve authorized by the seller. It is your responsibility to read the specific terms and conditions for each property and be informed of the specific terms and conditions that apply to that particular property. Announcements and information, provided on the Expert Home Auctions International website will take precedence over printed marketing material or verbal assertions. THE PROPERTY IS SOLD "AS IS," WITH NO CONTINGINCIES RELATED TO FINANCING APPRAISAL OR INSPECTIONS AND ALL SALES ARE FINAL. THE SUCCESSFUL BIDDER ACKNOWLEDGES THAT THE AUCTIONEER AND THE SELLER HAVE MADE NO EXPRESSED OR IMPLIED WARRANTY OR REPRESENTATION OF ANY TYPE AS TO THE PROPERTY AND THAT THE PROPERTY IS SOLD WITHOUT ANY WARRANTIES WHATSOEVER, EXPRESSED OR IMPLIED AND SPECIFICALLY THERE IS NO WARRANTY AS TO  MARKETABILITY OR MARKET VALUE AND NO WARRANTY AS TO ITS FITNESS FOR ANY PARTICULAR PURPOSE OR USE.  

Cash, Conventional or FHA Financing may be accepted. Please check the terms and conditions for the specific property of your interest to see what financing is allowed. FHA buyers may use our lender or when using their own lender, must provide a letter from their lender that they may participate in an auction with that lender and that they are allowed by that lender to pay a buyer’s transaction fee. FHA has no rules against auctions or paying a buyer’s transaction fee. The fee is outside the loan. We have a white paper for your lender. Download and print the white paper in the bidder’s package where applicable. Buyer's transaction fee will be paid by the winning FHA bidder with their own funds.

Though all descriptions and information are believed to be correct, in no event shall auctioneer or seller be held responsible for having made or implied any warranty of description, genuineness, condition etc. Buyer is to verify all information provided on the website. The property is open to thorough public inspection at the published property preview dates. Buyers must sign in to view the property. Auctioneer reserves the right to withdraw any item before or during the auction. Auctioneer reserves the right to bid on behalf of the seller up to but not past the contract reserve price. Only registered bidders may bid on the property being sold, any exceptions to this requirement shall be within the sole discretion of the Auctioneer. No allowances, adjustments or rescission of sale will be allowed based upon failure of the property to correspond to a particular need or use. The registered bidder will be responsible for any bid or purchase made with his or her unique Expert Home Auctions International username and password.

A BUYERS PREMIUM OF 5-10%, AS SPECIFIED IN THE TERMS AND CONDITIONS FOR EACH PROPERTY, WILL BE CHARGED TO THE BUYER AS A CLOSING COST, DUE AND PAYABLE AT CLOSE OF ESCROW. PLEASE CHECK THE SPECIFIC PROPERTY FOR THE BUYER’S PREMIUM CHARGED FOR THAT PROPERTY. THIS FEE IS PAID DIRECTLY TO EXPERT HOME AUCTIONS INTERNATIONAL AND IS NOT INCLUDED IN THE PURCHASE PRICE.

  

Bidder acknowledges that a security deposit of $2,500.00 (may vary per property) is required within 48 hours upon being declared the winning bidder; this money will be deposited into Listing Brokers trust account until time of closing when it is transferred to escrow. If bidder is a first or second runner up and does not submit an offer as a backup within 48 hours they may not be considered should the winner be unable to perform. To insure your place in line as a winner, submit your offer.

 

RESPONSIBILITY OF BIDDER AND INDEMNIFICATION: Bidder agrees to assume the defense of and indemnify and hold harmless Expert Home Auctions International and EHAI employees, officers, or independent contractors and the Listing Broker for all claims, loss, damage, injury and liability of every and any kind, directly or indirectly caused by acts of bidder and/or it’s agents in connection with this auction or the use of the property by the successful bidder. If the foregoing conditions or any other applicable conditions are not complied with, in addition to other remedies available to Expert Home Auctions International and EHAI employees, officers, or independent contractors and the Listing Broker and the Seller by law, including, without limitation, the right to hold the successful bidder liable for the bid price. Expert Home Auctions International and EHAI employees, officers, or independent contractors and the Listing Broker, as its option may either (a) cancel the sale, retaining as liquidated damages all payments made by the successful bidder or (b) resell the property publicly or privately and in such event, the successful bidder shall be liable for payment of any deficiency plus all costs, including the holding costs of the property, the expense of both sales and Expert Home Auctions International transaction fee and incidental damages. In any action to enforce and/or recover damages pursuant to this document Listing Broker shall be entitled to recover its attorney fees, expenses and all cost of suit incurred in such action. If you are the high bidder and fail to sign the purchase contract within 48 hours you forfeit your bid and agree to pay Expert Home Auctions International any collections and/or attorney fees. 

 

BROKER PARTICIPATION INVITED: Subject to established guidelines outlined in Broker Participation Agreement. It is Buyer’s responsibility to verify all permits, property use and property specifications before placing a bid. It is not recommended that a broker or realtor bid for their client unless their client is unable to use a computer.
